Terms of Service

1. Acceptance of Terms

By accessing, browsing, registering for, listing on, claiming a profile on, purchasing a membership for, advertising on, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you use the Service on behalf of a business or other entity, you represent that you have authority to bind that entity, and “you” includes that entity.

If you do not agree to these Terms, you must not use the Service.

2. Definitions

• User / Consumer: any person browsing or using the Service without operating a business listing dashboard.
• Business Owner / Merchant: a person or entity that lists, claims, manages, or advertises a business on BizBook Goa.
• Listing: a business profile published or pending publication on the Service.
• Membership / Plan: a Free or paid subscription package with defined features and billing cycle.
• GSTIN: Goods and Services Tax Identification Number provided for invoicing and Input Tax Credit (ITC) purposes.
• Partner Services: services delivered by third parties in connection with the Service (for example payment gateways or complimentary website fulfilment partners).

3. About the Service

BizBook Goa is a brand of McFly World Communications Private Limited and a local business directory and growth platform focused on Goa, India. Features may include (without limitation): business search and discovery; category and location pages; reviews and bookmarks; jobs, events, and offers; tourist attractions and things-to-do content; business dashboards; lead and booking tools; memberships; and advertising products such as BizBook Ads Campaigns.

We may add, change, suspend, or discontinue any feature, plan, pricing display, or portion of the Service at any time, with or without notice, subject to applicable law and any vested rights under an active paid subscription period already paid for.

4. Eligibility & Accounts

• You must be legally capable of entering into a binding contract under applicable Indian law.
• You must provide accurate, current, and complete registration and profile information, and keep it updated.
• You are responsible for safeguarding login credentials and for all activity under your account.
• You must notify us promptly of any suspected unauthorised access or security incident involving your account.
• One person or entity may not create accounts to evade suspension, verification, billing, or moderation decisions.
• We may refuse registration, require identity or business verification, or suspend accounts that appear fraudulent, abusive, or incomplete.

5. Consumer Use of the Directory

Directory content is provided for general information and discovery. Listing details, prices, hours, offers, reviews, and contact information may change and may be supplied by Business Owners or third-party sources. Always verify critical details (including pricing, availability, licences, and safety) directly with the business before visiting, booking, or purchasing.

BizBook Goa is not a party to transactions between Users and businesses unless expressly stated in writing for a specific product.

6. Business Listings, Claims & Verification

6.1 Submitting or managing a listing

• You represent that you are the owner or an authorised representative of the business.
• Listing information must be accurate, lawful, non-misleading, and free of infringing or prohibited content.
• You are responsible for licences, permits, tax registrations, and regulatory compliance applicable to your business.
• Photos, logos, menus, and media you upload must be owned by you or used with permission.

6.2 Claims of existing / imported profiles

• Claiming a listing requires proof or credible demonstration of authority to manage the business profile.
• We may request documents, phone/email verification, or other checks before approving a claim.
• Approval of a claim grants management access to the listing tools; it does not transfer ownership of the BizBook Goa platform, brand, software, or data infrastructure.
• Disputed claims may be paused, rejected, or reversed pending review.

6.3 Moderation rights

We may edit, reject, delist, feature, demote, suspend, or remove listings, media, or account privileges at our discretion where content appears inaccurate, unlawful, spammy, unsafe, misleading, duplicate, or otherwise harmful to Users or the Service.

7. Membership Plans, Pricing & GST

• Plan features, limits, and pricing are described on the Pricing page and/or at checkout. Published features may vary by billing cycle (monthly / yearly) and plan tier.
• Unless expressly stated otherwise, listed plan prices are exclusive of Goods and Services Tax (GST).
• At checkout, applicable GST (currently 18% unless changed by law or configuration) is calculated and shown in a price breakup before payment. The amount charged by the payment gateway is the taxable value plus GST (the “Total Payable”).
• You may optionally provide a valid GSTIN at checkout or on your business profile so that we can attempt to issue GST-compliant invoices enabling you to claim Input Tax Credit (ITC), subject to applicable GST law and your eligibility. Providing an incorrect GSTIN may delay or invalidate ITC claims; correcting GSTIN details is your responsibility.
• Free plans do not include paid entitlements. Upgrades, downgrades, and renewals are governed by the plan terms active at the time of change.
• We may change future plan prices or feature bundles prospectively. Changes generally do not reduce entitlements already paid for during an active billing period, except where required by law or for security / abuse prevention.

8. Payments, Refunds & Cancellations

• Paid memberships and eligible advertising charges are processed through third-party payment providers such as Razorpay. Card and bank details are handled by those providers under their terms and privacy policies.
• A subscription becomes active after successful payment confirmation (or immediately for Free plans where applicable). Pending checkouts may expire or require retry.
• No refunds: paid digital memberships and advertising are non-refundable once payment succeeds and entitlements are made available, as set out in our Refund Policy. Narrow exceptions apply only for duplicate charges or confirmed failed payments after debit.
• Failure to pay, chargebacks without valid cause, or payment disputes may result in suspension of premium features, advertising, or listing tools until resolved.
• You are responsible for any bank, gateway, foreign exchange, or payment-method fees charged by your provider.

9. Complimentary Website Offer

Certain yearly memberships (currently Gold yearly, Platinum yearly, and Enterprise, as described on Pricing) may include a complimentary business website benefit fulfilled in partnership with McFly World or another designated fulfilment partner (“Website Benefit”).

• The Website Benefit (including approximate page count, domain, hosting/server period, and development scope) is defined by the plan variant stated at the time of purchase and may include time-limited domain/hosting coverage (for example one year) unless otherwise specified in writing.
• Eligibility requires an active qualifying yearly membership, successful payment, and completion of onboarding / brand brief requirements requested by us or the fulfilment partner.
• Delivery timelines depend on timely inputs from you (copy, logos, photos, approvals). Delays caused by incomplete briefs are not a breach by BizBook Goa.
• The Website Benefit is a promotional / bundled service benefit and has no cash alternative. It is not transferable and may be withdrawn for future purchasers if the offer is discontinued; existing eligible members will be handled as communicated at purchase or in writing.
• Domain renewal, hosting renewal after the included period, extra pages, custom development beyond the stated scope, and third-party licence fees are your responsibility unless expressly included.
• Intellectual property in custom website deliverables may be governed by a separate assignment or licence between you and the fulfilment partner; BizBook Goa is not the website host of record unless stated otherwise.

10. Advertising & BizBook Ads

• Advertising products (including campaigns, credits, placements, and sponsored visibility) are subject to campaign rules, budgets, targeting limits, and moderation.
• Ad creatives and landing destinations must be accurate, lawful, and consistent with your business. We may pause or reject ads that appear misleading, prohibited, or low quality.
• Ad credits, impressions, clicks, and performance metrics are estimates based on available systems and are not a guarantee of leads, sales, or ranking outcomes.
• Unused credits may expire according to plan or campaign rules disclosed in-product.

11. Bookings, Leads & Enquiries

• Lead forms, WhatsApp/call CTAs, booking enquiry tools, and similar features facilitate introductions. Unless explicitly stated, BizBook Goa does not confirm inventory, take payments for the underlying service, or guarantee fulfilment by the business.
• Business Owners must respond lawfully and professionally to leads and bookings and must not misuse User contact data for spam or unrelated marketing without consent.
• Users should independently confirm booking terms, deposits, cancellations, and safety requirements with the business.

12. Jobs, Events, Offers & Media

• Job posts, events, offers/coupons, and media galleries must be truthful and compliant with applicable employment, advertising, and consumer laws.
• Offer terms (validity, exclusions, redemption) must be clearly stated by the Business Owner and honoured as published, subject to lawful changes with reasonable notice.
• We may remove expired, misleading, discriminatory, or unsafe posts.

13. User Content, Reviews & Licence

“User Content” means any text, reviews, ratings, photos, videos, logos, job posts, events, offers, messages, or other materials you submit to the Service.

• You retain ownership of your User Content, subject to the licence below and any rights of third parties.
• You grant BizBook Goa a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to host, store, reproduce, adapt, publish, translate, distribute, and display User Content in connection with operating, promoting, and improving the Service (including in search results, emails, social snippets, and archives).
• Reviews must reflect genuine experiences. Fake, incentivised-without-disclosure, defamatory, harassing, or manipulated reviews are prohibited.
• We may moderate, edit for formatting, refuse, or remove User Content that violates these Terms or law, without obligation to monitor all content in advance.

14. Editorial & Informational Content

Pages such as tourist attractions, things to do, blogs, guides, and similar editorial content are provided for informational and travel-inspiration purposes. Timings, fees, access rules, and conditions can change. Always verify with official sources before travel. BizBook Goa is not liable for decisions made solely based on editorial content.

15. Acceptable Use

You agree not to, and not to assist others to:

• Use the Service for unlawful, fraudulent, deceptive, or harmful purposes.
• Scrape, harvest, spider, or bulk-export data except through documented APIs or written permission.
• Attempt unauthorised access to accounts, systems, networks, or non-public data.
• Upload malware, spam, phishing content, or abusive automation.
• Impersonate any person or business, or misrepresent affiliation.
• Interfere with Service integrity, ranking systems, ad delivery, or other users' experience.
• Post content that is illegal, discriminatory, pornographic, or that infringes IP, privacy, or publicity rights.
• Circumvent plan limits, verification, payment, or moderation controls.

16. Intellectual Property

The BizBook Goa name, logos, design system, software, databases, and original platform content are owned by us or our licensors and are protected by applicable IP laws. You may not copy, reverse engineer (except where mandatory law permits), frame, mirror, or commercially exploit the Service without prior written consent.

Business names, trademarks, and creative assets supplied by Business Owners remain their responsibility. Feedback you provide about the Service may be used by us without obligation to compensate you.

17. Third-Party Services

The Service may integrate or link to third parties including payment gateways (e.g. Razorpay), maps, messaging/WhatsApp, analytics, hosting, email providers, Google-related data sources, and fulfilment partners such as McFly World for Website Benefits. Those services are governed by their own terms and privacy practices. BizBook Goa is not responsible for third-party outages, policies, or acts/omissions except to the extent required by mandatory law.

18. Disclaimers

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT LISTINGS, REVIEWS, ADS, SEARCH RANKINGS, OR LEADS WILL MEET YOUR EXPECTATIONS OR GENERATE REVENUE.

19. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MCFLY WORLD COMMUNICATIONS PRIVATE LIMITED, THE BIZBOOK GOA BRAND, AND THEIR AFFILIATES AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) INR 5,000, EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER MANDATORY LAW (INCLUDING APPLICABLE CONSUMER PROTECTION LAW).

20. Indemnity

You agree to indemnify, defend, and hold harmless McFly World Communications Private Limited, the BizBook Goa brand, and their officers, employees, and partners from and against claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your User Content; (b) your listings, ads, offers, jobs, or events; (c) your breach of these Terms or law; (d) disputes between you and Users or other businesses; or (e) your misuse of leads, personal data, or Partner Services.

21. Suspension & Termination

We may suspend or terminate access to all or part of the Service immediately if you breach these Terms, if required by law, or for risk, fraud, security, or operational reasons. You may stop using the Service at any time. Upon termination, licences granted to you end, but licences you granted to us for User Content may survive as needed for backups, legal compliance, and residual displays already distributed. Sections that by nature should survive (including IP, payment obligations, disclaimers, liability limits, indemnity, and governing law) will survive termination.

22. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date will change when we do. Material changes may be highlighted on the Service or communicated by email where appropriate. Continued use after changes become effective constitutes acceptance of the revised Terms, except where mandatory law requires separate consent.

23. Governing Law & Disputes

These Terms are governed by the laws of India. Subject to any mandatory consumer protections, courts at Goa, India shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service. You and we will first attempt to resolve disputes in good faith through our Contact channels.
